The purpose of this paper is to present the Qumran conception of temple as an intermediate stage between the understanding of temple in Jewish eschatology and the Ismaili innerness of the “temple of light.” All of it in the frame of the conception of temple as Garden of Eden based in the “alternative memory”2 yielded by parabiblical priestly traditions.

Audio description remains the cornerstone of accessibility for visually impaired audiences to all sorts of audiovisual content, including porn. Existing work points to the efficacy of audio description to guarantee immersion and emotional engagement, but evidence on its role in sexual arousal and engagement in porn is still scant. The present study takes on this challenge by comparing sighted and visually impaired participants’ experiences with porn in terms of their physiological response [i.e., cortisol and heart rate ] and self-report measures (...) of affect [Positive and Negative Affect Schedule ; Watson et al., 1988], anxiety [State-Trait Anxiety Inventory ; Spielberger et al., 1970], sexual reactivity and arousal [Sexual Inhibition/Sexual Excitation Scale ; Moyano and Sierra ; and the Ratings of Sexual Arousal ; Mosher ], and narrative engagement or transportation [The Transport Narrative Questionnaire, Green and Brock ]. 69 Spanish participants were allocated into three different groups: 25 sighted participants who watched and heard the porn scenes in their audio-visual version ; 22 sighted participants who listened to the audio described version without images ; and 22 visually impaired participants who also listened to the audio described version without images. Overall, results on physiological and self-report measures revealed no significant differences between groups or different versions of the clips. The analysis of cortisol reactivity to porn as the maximum increase or decrease in cortisol with respect to baseline values revealed no significant differences between the groups, but pointed to a higher percentage of non-responders than responders in the three groups, the highest being found in the ONCE group. As for participants’ cardiac response to the clips, no significant differences were found across the groups, with the highest HR levels being registered in the baseline phase. Self-report measures revealed significant between-group differences in negative affect. The ONCE group displayed the highest pre-task levels of negative affect and was the only group that showed a decrease in negative affect after exposure to the clips. Sighted and visually impaired participants reported to be moderately aroused and immersed in the films, regardless of exposure to AV or AD porn. In addition, correlations found between participants’ levels of self-report sexual arousal and transportation and post-task affect pointed to a positive relationship between exposure to porn and perceived levels of sexual arousal and affect. Results from the study reflected the efficacy of audio description in providing sighted and visually impaired audiences with a similar experience to that offered by original AV porn scenes. This study is exploratory but provides valid, initial groundwork for further research on the impact of audio description on porn reception. (shrink)

Este artículo ofrece una revisión sistemática de los debates sobre el anglo-eurocentrismo en los currículos universitarios de filosofía, enfocándose en la necesidad de mayor diversidad cultural. A partir de la revisión de 52 estudios de la última década, se distinguen seis debates principales que develan las implicaciones del anglo-eurocentrismo en la filosofía académica: 1) reconocer el etnocentrismo anglo-eurocéntrico en la identidad disciplinaria de la filosofía, 2) tomarse en serio el multiculturalismo filosófico, 3) recurrir en todo o en parte a las (...) filosofías comparadas, 4) buscar la diversidad mediante la filosofía intercultural, 5) girar la tuerca: de la normalización de la colonialidad filosófica a la interculturalidad nuestroamericana, y 6) incorporar las lecciones africanas contemporáneas para la diversificación del currículo filosófico. El artículo proporciona una guía orientativa de estos debates, resaltando las premisas y tesis en juego. Finalmente, se concluye con la sugerencia de repensar los currículos de los programas académicos de filosofía de las universidades colombianas al compás de la Política de educación superior inclusiva e intercultural. Despite substantial research on overall decision-making capacity levels in schizophrenia, the factors that cause individuals to make errors when making decisions regarding research participation or treatment are relatively unknown. We examined the responses of 84 individuals, middle-aged or older, with schizophrenia or schizoaffective disorder. We used a structured decision-making capacity measure, the MacArthur Competence Assessment Tool for Clinical Research, to determine the frequency and apparent cause of participants’ errors. We found that most errors were due to difficulty recalling the disclosed (...) information, particularly the study’s procedures, potential risks, and purpose. Errors attributable to concrete thinking, psychotic symptoms, or perceived coercion were rarer. These results suggest that informed consent procedures for this population might be improved by providing information in a way that facilitates learning and memory, such as iterative disclosure of the information, corrective feedback, and emphasis of key points of the study—for instance, its purpose, procedures, and potential risks. Nichelle Cherry (bio), and Martina Darragh* (bio)In 1995, the Joint Commission on Accreditation of Healthcare Organizations (JCAHO) expanded its patient rights standards to include requirements for assuring that hospital business practices would be ethical. Renamed “Patient Rights and Organization Ethics,” these standards are based on the realization that a hospital’s obligation to (...) its patients is derived from two relationships: the patient-provider relationship governed by “clinical ethics,” and the customer-supplier relationship governed by “business ethics.” “[This] boundary between ‘clinical’ ethics and ‘business’ ethics is not clear and in many cases is nonexistent. While marketing and admission practices are seen as issues related to ‘business’ ethics, they can lead to unneeded admissions or demand for unneeded services, both of which can unnecessarily expose the patient to the risk of side effects or complications. Likewise, underutilization of needed services is likely to lead to less than optimal health outcomes” (I. Schyve 1996, p. 17). “These new standards arose out of well-publicized concerns about abuses in which patients were admitted to hospitals unnecessarily and were discharged or transferred only after their insurance expired” (I. Schyve 1996, pp. 15–16).These abuses also sparked eloquent protests against threats to patient well-being and to the nature of the patient-provider relationship in the bioethics literature. The fiduciary responsibility of the provider to inform and to protect the patient was fragmented by insurer business practices such as gag clauses and economic credentialing of providers (VII. The background role that the institution plays, though poorly articulated historically, has been brought sharply into focus by the explosive growth of the managed practice of medicine. The context of medical ethics is no longer limited to the resolution of individual cases, but instead encompasses the adoption of institutional structures to protect and promote patient welfare (IV. Emanuel 1995, p. 335). In this new configuration, the institution and the providers are co-fiduciaries for populations [End Page 189] of patients, and the medicine that is practiced is “appropriately economically disciplined.” The expression “My patient always comes first” is no longer “... intellectually serious or morally responsible.” But, “... to be sure, both conceptually and in practice, being an economically disciplined fiduciary professional or institution is ethically unstable.... Many families worldwide have at least one member with a behavioral or mental disorder, and yet the majority of the public fails to correctly recognize symptoms of mental illness. Previous research has found that Mental Health Literacy (MHL)—the knowledge and positive beliefs about mental disorders—tends to be higher in European and North American cultures, compared to Asian and African cultures. Nonetheless quantitative research examining the variables that explain this cultural difference remains limited. The purpose of our study was fourfold: (a) (...) to validate measures of MHL cross-culturally, (b) to examine the MHL model quantitatively, (c) to investigate cultural differences in the MHL model, and (d) to examine collectivism as a predictor of MHL. We validated measures of MHL in European American and Indian samples. The results lend strong quantitative support to the MHL model. Recognition of symptoms of mental illness was a central variable: greater recognition predicted greater endorsement of social causes of mental illness and endorsement of professional help-seeking as well as lesser endorsement of lay help-seeking. The MHL model also showed an overwhelming cultural difference; namely, lay help-seeking beliefs played a central role in the Indian sample, and a negligible role in the European American sample. Further, collectivism was positively associated with causal beliefs of mental illness in the European American sample, and with lay help-seeking beliefs in the Indian sample. These findings demonstrate the importance of understanding cultural differences in beliefs about mental illness, particularly in relation to help-seeking beliefs. (shrink)

In an effort to meet growing stakeholder demands for transparency, accountability, and responsibility, many large organizations globally have voluntarily adopted the Global Reporting Initiative guidelines. Moreover, triggered by recent management transgressions, the ancient virtue of practical wisdom has gained increased attention from management scholars, who argue that the Aristotelian concept, with its interdisciplinary nature, has the capacity of turning management back into a holistic, contextual, and virtue-orientated practice. Especially the fact that practical wisdom is firmly based on normative values, coupled (...) with the emphasis on experience and practice, makes it well suited as a leitmotif for sustainable and responsible management. This conceptual paper builds on the link between practical wisdom and sustainability. I argue that the GRI may be regarded as an example of procedural practical wisdom in the context of sustainability reporting, specifically in terms of its emphasis on the holistic and situational dimensions, articulated through the concepts of materiality analysis and stakeholder dialogue. Practical implications, limitations, and avenues for further research are discussed. (shrink)

Research with human–animal chimera raises a number of ethical concerns, especially when neural stem cells are transplanted into the brains of non-human primates . Besides animal welfare concerns and ethical issues associated with the use of embryonic stem cells, the research is also regarded as controversial from the standpoint of NHPs developing cognitive or behavioural capabilities that are regarded as “unique” to humans. However, scientists are urging to test new therapeutic approaches for neurological diseases in primate models as they better (...) mimic human physiology than all current animal models. As a response, various countries have issued reports on the topic. Our paper summarizes the ethical issues raised by research with human–animal brain chimeras and compares the relevant regulatory instruments and different recommendations issued in national reports from three important European research nations: Germany, Switzerland and the United Kingdom. We assess and discuss the focus and priorities set by the different reports, review various reasons for and perspectives on the importance of the brain in chimera research, and identify critical points in the reports that warrant further specification and debate. Between 1905 and 1945, 31 states in the Untied States and 2 provinces in Canada enacted sterilization legislation. Over 70 statutes and amendments were enacted to guide, oversee and regulate sterilization practice, while over 24 distinct conditions were offered as grounds for sterilization. Although excellent legal, historical, and philosophical scholarship has investigated the motivations, causes and consequences of this legislation, little work has been done to explicitly systematic analyse the language used in sterilization legislation. This brief study attempts to fill (...) some of the gap by attending to a number of questions that arise in the context of sterilization legislation. Five questions are addressed: Are there any patterns to the eugenic language in sterilization legislation? Does the eugenic sterilization language reflect what is found on other eugenic lists? What can sterilization language tell us about the mechanics of eugenics? What can sterilization legislation reveal about the role of feeble-mindedness or mental deficiency in eugenic history? And finally, what might sterilization language tell us about eugenic thought more generally? In answering these questions, we look to add one more piece to the puzzle that is eugenic history in North America. (shrink)

Do not chew with your mouth open! Take your hat off when you enter a church! Do not skip the queue! Pay your taxes! Do not cross on a red light! These are familiar imperatives, and their immediate source are ‘socially constructed norms’: norms that exist as a matter of social fact. These range from informal etiquette and politeness norms to the complex norms making up our legal systems. While we often feel bound by these norms, we are also aware (...) that they can be pernicious: the product of injustice and vehicles for its perpetuation. The question thus arises: when and why, if ever, does the fact that a socially constructed norm requires us to perform a certain action place us under a genuine moral obligation to comply? In Morality and Socially Constructed Norms, I answer that such an obligation, when it exists, is grounded in a broader, familiar duty, namely the duty to respect people’s permissible and authentic exercises of agency. This is what I call the ‘Agency-Respect View.’ The first part of the book outlines and defends the view, the second part considers relevant applications. (shrink)

Chelicerates (scorpions, horseshoe crabs, spiders, mites and ticks) are the second largest group of arthropods and are of immense importance for fundamental and applied science. They occupy a basal phylogenetic position within the phylum Arthropoda, and are of crucial significance for understanding the evolution of various arthropod lineages. Chelicerates are vectors of human diseases, such as ticks, and major agricultural pests, such as spider mites, thus this group is also of importance for both medicine and agriculture. The developmental genetics of (...) chelicerates is poorly understood and a challenge for the future progress for many aspects of chelicerate biology is the development of a model organism for this group. Toward this end, we are developing a chelicerate genetic model: the two‐spotted spider mite Tetranychus urticae. T. urticae has the smallest genome of any arthropod determined so far (75 Mbp, 60% of the size of the Drosophila genome), undergoes rapid development and is easy to maintain in the laboratory. These features make T. urticae a promising reference organism for the economically important, poorly studied and species‐rich chelicerate lineage. In this article, Laura Quintana elaborates on a conceptual distinction between violence and rage. Along with this distinction, she recognises that while rage may possess a destructive potential, it can also be politicised in emancipatory practices that confront conditions of injustice and structural violence. Her analysis centers on contemporary political movements in Latin America, which she views as collective manifestations of rage. Within these movements, the manifestation of rage is intertwined with forms of care and communal labor. Quintana characterises (...) such movements as embodying a “dignified rage” (digna rabia) that calls for an emancipatory transformation of the status quo. She contends that these practices can be understood in terms of the notion of “anti-violence,” as it has been coined by Étienne Balibar. In this she diverges from Judith Butler, since, according to Quintana’s analysis, such practices challenge the demand for non-violence that has often served to neutralise the disruptive force of such manifestations and movements. But the similarity between the two apparatus, the nervous system and the electric telegraph, has a much (...) deeper foundation. It is more than similarity; it is a kinship between the two, an agreement not merely of the effects, but also perhaps of the causes. 1In 1851 the telegraph and the nervous system appeared to be doing the same things and for the same reasons. Their common purpose was the transmission of information, and they both conveyed this information as alterations in electrical signals. By calling the nervous system a "model" for the telegraph, DuBois-Reymond suggested that organic communications systems offered solutions to problems encountered by technological ones.In the same decade, however, Claude Bernard remained skeptical about the epistemological value of metaphor. [End Page 105]Many scientific investigators have shared Bernard's concern that claims of likeness will change their perceptions of physiological systems, but for the same reason some scholars of language are more optimistic about the epistemological possibilities of metaphor. George Lakoff and Mark Johnson assert that the role of metaphor in scientific thinking provides one of the best illustrations of how metaphors reflect and influence what we see and do. "Formal scientific theories are attempts to consistently extend a set of ontological and structural metaphors," they argue. 3 This "extension," though, is just what worried Bernard. Metaphors provoke and give birth to new images. By establishing and reinforcing connections, they encourage us to see in new ways. While Bernard is correct that assertions of likeness alter the way we see, Lakoff and Johnson are equally correct in claiming that "much of cultural change arises from the introduction of new metaphorical concepts and the loss of old ones." 4 Alterations in the way we see can be extremely productive.One of the most intriguing cases through which to study the epistemological role of metaphor is that of comparisons between physiological and technological communications systems. Throughout the nineteenth century scientists' electrophysiological understanding of the nervous system closely paralleled technological knowledge that allowed for the construction of telegraph networks. Timothy Lenoir has demonstrated that Hermann Helmholtz and Emil DuBois-Reymond, the nineteenth-century scientists who made some of the greatest contributions to neurophysiology, worked closely with communications engineers like Werner Siemens. By developing models that reflected the apparatus they had adapted from physics and media technology, Helmholtz, and DuBois-Reymond changed people's understanding of the way nerves transmitted impulses. I agree with Lenoir that these comparisons between organic and technological systems were not mere devices for popularization but became incorporated into the scientists' own vision and understanding of the nervous system. 5 When one reads the proposals of nineteenth-century engineers, one begins to suspect that communication in the body and in society can only be understood in terms of each other. But can one claim that comparisons of communication mediated by bodies and machines actually contributed to knowledge of the nervous system and of early telecommunications networks?From the late eighteenth century onward, scientists studying organic and technological communications systems continually inspired one another. Despite recent efforts, little research has been done concerning the issue of medical ethics in Georges Canguilhem’s work. This is mainly due to the critical position the author takes regarding the humanistic medicine practices that began to proliferate after World War II. However, we hold that the medical philosopher´s insights do contribute to the field of medical ethics, since they rescue the patients’ individuality, which is highly valued in today´s person centered medicine: over the “objectifying” rationality of modern medicine. Many, if not most, of the spectacular innovations in the medical understanding and treatment of today's human maladies have been based on research using (...) animals. However, the use of animals in research and experimentation has been debated, defended, and protested by both individuals and organizations at various levels. Responses range from personal lifestyle decisions and fervent philosophical treatises to strident arguments, violent demonstrations, and direct action. The continuum of attitudes about animals and the human relationship with animals spans the range between those who support no regulation of the human use of animals and those who advocate absolute animal liberation from all human use (see II, Orlans 1993, p. 22). History The first recorded experimentation on animals occurred in ancient Rome, but not until the Renaissance did scholars begin serious study of how the body works. Leonardo da Vinci (1452-1519) and other artists and anatomists pursued anatomical investigations of muscle and bone structure. William Harvey (1578-1657) discovered the circulation of the blood via his experiments on live deer. During this period, much live animal experimentation both in England and France was based on the view of French philosopher René Descartes (1596-1650) that animals are incapable of feeling pain. Jeremy Bentham (1748-1832), the English utilitarian philosopher, thought otherwise. In his "Introduction to the Principles of Morals and Legislation" in 1789, Bentham declared, "The question is not, can they reason? Nor, can they talk? But can they suffer? Despite Bentham and others, the belief that animals could not perceive pain persisted in many quarters into the twentieth century. Nineteenth century French physiologist Claude Bernard [End Page 91] (1813-1878)-and his teacher, François Magendie (1783-1855)-conducted wide-ranging animal experiments including surgery, use of drugs, and removal of body parts from many species. Bernard argued that while no amount of benefit could justify any harm to human research subjects, even extreme harm and pain for animal research subjects could be justified by the potential benefit to human beings. Although he did use anesthetics in his work after their discovery in 1847, even Bernard's later work was controversial because of the numbers of animals used and the repetitive nature of his research. The experiments of Magendie and Bernard both laid the foundations for animal experimentation as a practice for scientific advance and contributed in large measure to the emergence of the anti-vivisection movement. Public protests over animal experiments conducted in France and the fear that these might come to England led to the passage of the first law controlling animal experimentation, the "1876 Cruelty to Animals Act" in England. A recent article in Time magazine mentions the first major scientific conerence on Gaia, sponsored by the American Geophysical Union in 1988.1 The scientists ended their meeting by giving James Lovelock an exuberant standing ovation. Lovelock 's book (...) Gaia: A New Look at Life on Earth, first published in 1979, is now in its second edition.2 James E. Lovelock, British atmospheric chemist, introduced the Gaia hypothesis in 1975. This hypothesis emerged from his comparison of the chemical composition of Earth's atmosphere with the atmospheres of Venus and Mars. He found the contrast striking: Earth's atmosphere, hospitable to life, is markedly unlike the atmospheres of her two closest neighbors, Venus and Mars, both considered lifeless. Unsatisfied with mere chance as an explanation of this difference, Lovelock attributed a kind of active influence on the atmosphere by the whole of living organisms (called the biosphere) to effect conditions favorable for life. This led to the formulation of the proposition that living matter, the air, the oceans, the land surface were parts of a giant system which was able to control temperature, the composition of the air and sea, the pH of the soil and so on as to be optimum for survival of the biosphere. The system seemed to exhibit the behaviour of a single organism, even a living creature. IlievaThe following is a summary of the 2021 Postgraduate Conference titled "Dynamic Encounters between Buddhism and the West," which took place online on June 28 and 29. The conference was conceptualized, organized, and run by three AHRC funded PhD students at the University of Cambridge: Laura Langone (Faculty of Modern and Medieval Languages); Alexandra S. Ilieva (...) (Faculty of Divinity); and Harry Harland (Faculty of Law). The conference took place over two days and featured eighteen presenters across six panels, and two keynote speakers. There were speakers from four continents (Europe, North America, Asia, and Oceania). A wide range of topics in multiple fields was discussed: religious studies, neuroscience, art history, politics, philosophy, literature, philology, mathematics, art, and music. Each day consisted of three panels, each with three presentations, one keynote presentation, and a networking session.The keynote speakers were Prof. Albrecht Classen (The University of Arizona) and Prof. Graham Parkes (University of Vienna).Prof. Classen opened the conference with his presentation. He taught us that we have been globalized and transcultural since at least the Middle Ages. To support this claim, he provided us with ample evidence of Buddhist-Western exchanges in Art and Literature dotted throughout the literature and architecture of Europe. Prof. Parkes observed that following Zen Master Dōgen's thought as well as Nietzsche's philosophy we can develop a saner approach to the environment, which provides us with resources to help us to tackle the challenges of the climate crisis.Our first panel was titled "Hellenistic-Buddhist Encounters," which followed on nicely from Prof. Classen's thesis that encounters between Buddhism and the West have been ubiquitous and have dated as far back as the Hellenistic period. Our second panel, "Encounters with the Contemporary World," were impressive examples of intercultural philosophy. Each participant demonstrated a unique ability to bring Buddhist ideas into dialogue with contemporary Western philosophy, specifically ethics, philosophy of mathematics, and epistemology. The third panel, titled "Therapeutic Encounters," taught us of the therapeutic value of Buddhist meditation and philosophical inquiry. As our presenters emphasized, this therapeutic value is not just an ancient artifact to be studied anthropologically, but a relevant and applicable approach to the modern idea of well-being that therefore deserves continued scholarship.On the second day, we started with our fourth panel called "Encounters through Western Conceptual Lenses," which among others gave us insight into the reception [End Page 393] of Japanese Buddhism by the German liberal protestants of the nineteenth century. Our fifth panel—"Encounters with German Philosophy"—was an excellent example of contemporary comparative work between Buddhist philosophy, ethics, and logic, and the German thinkers Hegel and Nietzsche.We learned that Nietzsche labeled Buddhism as nihilism––a position that can be challenged through Ambedkar's reading of Buddhism. On the other hand, despite Nietzsche's criticism of Buddhism, striking similarities between his approach to life and that of Mahāyāna Buddhism can be found, both elaborating a life-affirming philosophy. We also became familiar with similarities and differences between the logic of Nishida and Hegel. Finally, our last panel, "Literary and Artistic Encounters" made for a fitting conclusion, reminding us that Buddhist-Western encounters are ongoing, not just politically and intellectually but also in art, music, and literature. These encounters are dynamic in nature and fundamentally lacking in an essential core. Instead, they are entities that echo through the ages allowing for reinterpretation and reintegration across geographic and temporal scopes.Both during and after the conference we received extremely positive feedback from the participants. The level of participation and enthusiasm was highly promising, showing that the future of intercultural studies of this sort is bright. Graduate conferences like these are key for early career scholars to set up networks and find likeminded peers to engage in ongoing dynamic encounters.In conclusion, this conference served to highlight the sophisticated emerging scholarship taking place that seeks to investigate Buddhist-Western interactions and dialogue. But, perhaps more importantly, the conference itself makes a metapoint: not only has the world been transcultural for many centuries, but the conference itself and in particular the global spatial locations of... The Fold is a book of practical philosophy that takes a radical new approach to aesthetics. Laura U. Marks calls this philosophy "enfolding-unfolding aesthetics," based in ideas derived from Gilles Deleuze and others (G.F.W. Leibniz, David Bohm, and Édouard Glissant) that the universe is folded in on itself. She proposes a theory of mediation as contact and connection across the folds and a set of embodied methods for detecting such cosmic connections. In drawing out this aesthetics, Marks considers the (...) embodied and sensuous dimensions of engaging with audiovisual works and works of art-dimensions that Marks suggests are composed of the very folds that compose everything and everyone: all living beings, from humans to particles, sandwiches to stars, technologies, thoughts and images, in the present, the past, and the future. Making use of art and film, with a focus on African diaspora and Arab cinema, Marks opens ways to strengthen connections to the cosmos and to better trace processes of becoming that are immanent within the fold. The intervention method of Developmental Dialogue, originally developed by Laura Mott , has been further elaborated to promote employees’ professional development and well-being. The aim of formative interventions is to enhance the agency of participants. There is particular interest in transformative agency, which is defined as participants’ capacity to take purposeful actions to change their work activity. By applying six types of agency expressions, this paper examines how transformative agency emerges in an interaction between a DD participant and the (...) interventionist. The agency expressions are analysed in the context of explicit and implicit intervention tools and objects of talk. The analysis yields a new category called reframing agency which is of interest particularly from a work-related well-being perspective. We interpret the findings with the notion of a contradictory object within the cycle model of professional development. The case suggests that changes in work, as interpreted by the researchers do not always fully grasp the participant’s sense of collective work. Finally, at the end of the paper we propose ideas for further research. (shrink)

In the present contribution we look at the legacy of Hilbert's programme in some recent developments in mathematics. Hilbert's ideas have seen new life in generalised and relativised forms by the hands of proof theorists and have been a source of motivation for the so--called reverse mathematics programme initiated by H. Friedman and S. Simpson. More recently Hilbert's programme has inspired T. Coquand and H. Lombardi to undertake a new approach to constructive algebra in which strong emphasis is laid on (...) the use of finite methods. The main aim is to eliminate the ideal objects and in so doing obtain more elementary and informative proofs. We survey some work in commutative algebra---mainly about and around the Zariski spectrum and the Krull dimension of a commutative ring---which witnesses the feasibility of such a revised Hilbert's programme. La estrategia argumental se basa en algunas de las principales intuiciones de la doctrina del doble efecto. En particular, se analiza el modo en que esta doctrina moral traza la diferencia entre daño instrumental y daño incidental. Dado que en la filosofía moral contemporánea se ha criticado severamente esa distinción, se elabora una respuesta a esas críticas. La arquitectura del derecho a la autodeterminación informativa, en su vertiente digital, está ahormada por la doctrina jurisprudencial. Ayuna de una regulación propia hasta la entrada en vigor del Reglamento General de Protección de Datos, el 25 de mayo de 2018, la autodeterminación informativa se ha ido conformando con el cincel de tres órganos jurisdiccionales (el Tribunal de Justicia de la Unión Europea, el Tribunal Constitucional y el Tribunal Supremo) que han ido perfilando y delimitando su contenido y alcance. Desde (...) su reconocimiento por el TJUE en su archiconocida decisión de 13 de mayo de 2014, la evolución que presenta es muy notoria. En la actualidad, una búsqueda en Internet con dos apellidos es suficiente para reconocer este derecho si con ello se lesiona el honor, la intimidad personal o familiar o la propia imagen de su titular. Así lo ha avalado el Tribunal Supremo en la STS 4016/2020, de 27 de noviembre. En este artículo se abordan los hitos jurisprudenciales más relevantes al objeto de bosquejar una cartografía jurídica actual del derecho a la autodeterminación informativa. (shrink)

This article presents an analysis of the structure and use of the Finnish independent infinitives. Although typological studies have shown that syntactically independent non-finite constructions are widespread in many languages, the understanding of their semantic and intersubjective motivation is still in its early stages. The current paper aims to enrich the understanding of independent non-finite constructions by closely looking at free-standing infinitive constructions in spoken and written Finnish: it combines theoretical concepts of Cognitive Grammar with the methodological tools of Interactional (...) Linguistics to explore the nature of independent infinitives as a resource for conceptualization and the intersubjective functions that it affords. The paper suggests that the fact that independent infinitives are grammatically ungrounded makes them useful in interactional and textual sequences involving affect display. As the indexical functions of infinitives can be explained from their own morphosyntactic and semantic characteristics, the paper makes the more general claim that there is no synchronic evidence that would support the assumption that such constructions ever evolved, via ellipsis, from finite constructions. Methodologically and theoretically, the paper advocates an approach that takes into account both the social and cognitive nature of language, and promotes the view that Cognitive Grammar offers a flexible, semantically rich starting point for the description of intersubjective meanings conveyed by grammar, when combined with the context-sensitive and microanalytical methodology of Interactional Linguistics. This article suggests that there are systematic ways in which the identity of the ‘self’, as created and performed through first-person markers, can be made relevant and consequential in particular episodes of interaction. More specifically, the study looks at generalizations that people present about themselves in local interactional contexts: displays of the types of people they are and the ways in which they always or never behave. It will be shown that such self-generalizations are typically used to account for one’s (...) behavior, and that this tendency is tied to the epistemic and moral rights provided by the first-person perspective, having the primary rights to one’s own experience. The study suggests that speakers’ personal characteristics or habitual behavior can be offered as a locally produced micro-identity, which can come to have interactional significance. (shrink)

In this comprehensive new study of human free agency, Laura Waddell Ekstrom critically surveys contemporary philosophical literature and provides a novel account of the conditions for free action. Ekstrom argues that incompatibilism concerning free will and causal determinism is true and thus the right account of the nature of free action must be indeterminist in nature.
